Our Story – Miscarriage of Justice Support Fund Inc.

Our vision

Miscarriage of justice affects victims and their families in many different ways, including but not limited to: legal, financial, emotional, social and health wise. The Miscarriage of Justice Support Fund Inc. aims to assist and support victims and their families to the best of its ability either directly or indirectly in these different spheres. In order to do so, our organisation depends on financial and/or in-kind contributions received from individual and corporate members and donors; and from grants and/or fundraising activities conducted from time to time. Our members also liaise and/or cooperate with other relevant organisations to help address the root causes of miscarriage of justice and thus assists society in general to overcome these problems. What Inspired Us

Natural reason alone is sufficient to understand the risks to all citizens of being unjustly accused and deprived of freedom when as many as one in ten of those jailed for serious crimes are potentially innocent.

As Martin Luther King Jr once said “Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny. Whatever affects one directly, affects all indirectly”.

It was Justice Kirby (1991:1047) who stated “it should be acknowledged wholeheartedly that, in too many cases, it has been the media rather than the institutions of justice or the judges, which have been vindicated… Embarrassing as it is to say… It was a band of loyal journalists who supported them, rather than the judicial institutions which actually led to the termination of that injustice”.

And so it is that for some of our members it was media reports concerning miscarriages of justice, for others the wrongful convictions of close relatives friends or clients  that motivated each of us to be part of the Miscarriage of Justice Support Fund Inc Association. Join us in our quest for justice everywhere by helping those victims nearest to us here today.

What We Are About

In our country’s legal system, all accused are to be presumed innocent until proven guilty and have the right to proper legal representation. Sometimes, for various reasons these rights are either not enforced, ignored or taken away due to inherent faults and imperfections in our justice system. Our association aims to assist victims of injustice enforce their rights. This may include financial and/or professional assistance.
 
Thanks to the support of our members and benefactors, our association aims to be able to assist victims of injustice and/or their legal representatives with financial or in-kind assistance in the form of expert advice, paralegal assistance, crowdfunding, raising awareness about their case through social media and the media in general.
 
Additionally, some of our members are advocates for the promotion and protection of human rights for the wrongfully accused, the wrongfully convicted and/or mistreated prisoners.
Through their dealings with miscarriages of justice, the victims, their legal representatives and others who are either part or have professional dealings with the justice system and/or services rendered to them, they become aware of global issues and root causes that need to be addressed in order to prevent these problems and their serious impact to our society. As such,  some of our members and associates, either directly or indirectly promote debate in relevant areas of law, government policy and/or practice.
 
Since miscarriage of justice can affect anybody living in Western Australia, Australia or the world, the activities of our association and of our members potentially benefit all citizens, but in particular those most in need: the wrongfully accused and incarcerated, their families and those individuals and organisations trying to assist them.
